Based on a review it conducted, the Federal Energy Regulatory Commission concluded that it did not, prior to 2009, produce or sponsor the distribution of influential scientific information (including highly influential scientific assessments) within the definitions promulgated by OMB. In 2009, the Commission, pursuant to Congressional direction, produced the National Assessment for Demand Response, which constitutes influential scientific information.

The Commission developed a Peer Review program for the Assessment and posts the following in accordance with OMB's Information Quality Bulletin for Peer Review:
