ORDER ON COMPLIANCE FILING

The order accepts New York Independent System Operator, Inc.’s Order No. 904 compliance filing, effective May 1, 2026.

E-6 | Southwest Power Pool, Inc., Docket No. ER22-1697-003
ORDER ON COMPLIANCE FILING

The order accepts Southwest Power Pool (SPP), Inc.’s second Order No. 2222 compliance filing, subject to a further compliance filing to be submitted within 60 days of the date of the order.

E-7 | Southwest Power Pool, Inc., Docket No. ER16-1341-003
ORDER ON REFUND PLAN

The order addresses SPP’s proposed refund plan by which it would unwind certain credit payment obligations assessed under Attachment Z2 of the SPP tariff for service taken from 2008 to 2016 and directs a further compliance filing to be submitted within 45 days of the date of the order.

E-8 | PJM Interconnection L.L.C., Docket No. ER24-98-002
ORDER ADDRESSING ARGUMENTS RAISED ON REHEARING AND SETTING ASIDE PRIOR ORDER, IN PART

The order addresses requests for rehearing of the Commission’s February 6, 2024, order rejecting, with guidance, PJM’s proposed changes to various rules governing the market seller offer cap and Capacity Performance. The order sustains the Commission’s determination to reject the filing but sets aside certain aspects of the order, including guidance addressing PJM’s alternative offer cap proposal.  The Commission also clarifies that PJM is not foreclosed from reintroducing its proposal in a future filing.

E-9 | ISO New England Inc., Docket No. ER20-2054-000
ORDER ON FORMAL CHALLENGE

The order accepts in part and denies in part Maine Office of Public Advocate’s request to require a subset of the New England Participating Transmission Owners to answer certain questions as part of the transmission formula rate protocols Information Exchange Period on the 2023 Annual Update.

E-10 | Duke Energy Carolinas, LLC, Docket No. EL25-89-000
ORDER ON PETITION FOR DECLARATORY ORDER

The order grants a petition for declaratory order from Duke Energy Carolinas, Duke Energy Progress, and Duke Energy Indiana requesting certain findings that would permit the operation of procurement subsidiaries for each public utility.


H-1 | Alutiiq Tribe of Old Harbor and Alaska Village Electric Cooperative, Inc., Project No. 13272-008
ORDER GRANTING STAY

The order grants a stay of the construction deadlines under Article 301 of the license for the Old Harbor Project No. 13272. The 262-kW unconstructed project was licensed in 2016 and will be located on East Fork Mountain Creek near the Alutiiq village of Old Harbor in Kodiak Island Borough, Alaska.

H-2 | Southeast Oklahoma Power Corporation, Project No. 14890-006
ORDER ADDRESSING ARUMENTS RAISED ON REHEARING

In response to a request for rehearing filed by Southeast Oklahoma Power Corporation, the order further explains and sustains the Commission staff’s April 14, 2025, letter terminating the integrated licensing process for the Pushmataha Pumped Storage Project. 

H-3 | Alabama Power Company, Project No. 349-250
ORDER ADDRESSING ARGUMENTS RAISED ON REHEARING

In response to a request for rehearing, the order further explains and sustains the Commission staff’s April 9, 2025, order approving, in part a Shoreline Management Plan Update for Alabama Power Company’s Martin Dam Hydroelectric Project, which allows Alabama Power to permit non-commercial piers, landings, boat docks, or similar structures that can accommodate up to 10 watercraft for condominiums and multi-family developments without authorization from the Commission.
