FERC today terminated several long pending proceedings to provide much needed regulatory certainty to the industries it regulates, at a critical moment of increasing energy demand and the need to build more energy infrastructure.  

“As the United States continues to strengthen its energy dominance, FERC is streamlining processes and enhancing regulatory certainty to help stakeholders plan, build, and invest with confidence. This includes closing out stale and unnecessary rulemaking proceedings to provide clarity on the rules of the road going forward,” said FERC Chairman Laura Swett. 

FERC terminated the following proceedings: 

  • M-1, RM22-20-000 | Duty of Candor Notice of Proposed Rulemaking: The order withdraws a proposed rule expanding the existing duty of candor. The Commission is also terminating the related rulemaking proceeding. 
  • G-3, RM18-10-000 | Airlines for America and National Propane Gas Association: The order denies a petition to develop affiliate conduct standards for liquid pipelines under the Interstate Commerce Act. 
  • G-4, RM20-7-000 | Safe Harbor Policy into the Commission’s Administrative Regulations: The order withdraws a proposed rule to codify the existing safe harbor policy on natural gas and electric price indices and terminates the related rulemaking proceeding. 
  • M-2, PL20-7-000 | Waiver of Tariff Requirements: The order withdraws and terminates a proposed rule expanding waiver analysis.  The Commission will continue to evaluate waiver requests on a case-by-case basis.
