Business Process for an Optional Notice Filing

Process

    Step 1: Tariff Filings: pursuant to 284.123(g).

    Step 2: Deficiency Review 284.123(g)v(2). Timeline: within 7 days.
    Questions: Is Filing Deficient?
    Answer: Yes, then go to Step 1. (Note: If filing was to fullfill 5yr. rate review - must refile in 14 days)
    Answer: No, then go to Step 3.

    Step 3: Secretary of Commission will notice the filing within 10 days 284.123(g)(3). Timeline: 7 to 10 days.

    Step 4: Intervention and Initial Comments 284.123(g)(3)&(4). Timeline: 10 to 21 days.

    Step 5: Prospects and Final Comments 284.123(g)(3)&(4). Timeline: 21 to 60 days.
    Questions: Are there any Unresolved Protests?
    Answer: Yes, then go to Step 6.
    Answer: No, then Filing Is Approved 284.123(g)(8)(i)

    Step 6: Reconciliation Period 284.123(g)(5). Timeline: 60 to 90 days.
    (Note: If a protest(s) is filed by Staff and/or Intervenors, then the intrastate pipeline, any protestant, and Staff will work, including technical conferences, to resolve the protest to achieve withdrawal of all protests (284.123(g)(6))).
    Questions: Are there any Unresolved Protests?
    Answer: Yes, then go to Step 7.
    Answer: No, then Filing Is Approved 284.123(g)(8)(ii)

    Step 7: Establishment of Procedure(s) to Resolve Filing 284.123(g)(5). Timeline: 90 to 120 days.

    The intrastate pipeline may amend (284.123(g)(7)) its filing to resolve a protest; the filing of the amendment will toll the notice period of the filing, and the Secretary of the Commission will establish new deadlines for comments and protests. The Secretary of the Commission may shorten the comment and protest period with respect to Tariff Filings: pursuant to 284.123(g) (go to Step 1).
