  1. You File a Notice of Intent to Construct a Qualifying Conduit Hydropower Facility
  2. Within 15 Days, FERC Makes an Initial Determination
    1. Facility Meets the Qualifying Criteria and
      1. FERC Issues a Public Notice Providing 30 Days to Intervene,
      2. 45 Days to Contest
        1. If No One Contests - Facility Deemed to Meet Qualifying Criteria
        2. If Someone Contests - FERC Issues an Order Determining Whether Facility Meets Qualifying Criteria
    2. Facility Does Not Meet the Qualifying Criteria
      • FERC Issues a Letter Finding Facility Fails to Meet Qualifying Criteria
    3. Insufficient Information to Make an Initial Determination
      • FERC Issues a Letter Rejecting the Filing
      • You have the Opportunity to Revise and Refile the Notice of Intent
