temperature of the following gas. the average, taken from the

record of the recording thermometer, during the time gas is

flowing, shall be deemed to be the gas temperature.

6. Gas delivered hereunder shall be delivered at such pressures as

exist in the respective line of the delivering party.

7. Gas delivered hereunder shall be deemed to be in the exclusive

possession and control of the delivering party until the same shall

have been delivered to the facilities of the other, after which it

shall be deemed to be in the exclusive possession and control of

the party receiving said delivery of gas. Each party shall be

responsible for any injury or damage caused by gas in its

possession and control.

8. United warrants title to all gas delivered to Humble Gas hereunder,

and Humble Gas warrants title to all gas delivered to United

hereunder.

9. The respective obligations for the parties hereunder are subject to

valid laws, orders, rules, and regulations of duly constituted

authorities having jurisdiction and to the receipt of all necessary

authorizations as may be required by such authorities.

If the foregoing is in accord with your understanding of our agreement,

please so indicate by signing and returning to us the original and one copy,

whereupon this letter will constitute an agreement between Humble Gas and

United from the date hereof until canceled by either party on 90 days written

notice to the other, after which all obligations of the parties hereunder

shall terminate except the obligation of either party to return any excess

gas which had been received by such party and not redelivered prior to such

termination date.
