13.2 In the event either Pipeline or Customer is rendered unable wholly
or in part, by force majeure to carry out its obligations, other
than the obligation to make payments due, then on giving notice
and reasonably full particulars of such force majeure in writing
within a reasonable time after the ccurrence of the cause relied
on, the obligations of the party giving such notice, so far as
they are affected by such force majeure, shall be suspended during
the continuance of an inability so caused, but no longer period,
and such cause shall so far as possible be remedied with all
reasonable dispatch.
14. BALANCING AND IMBALANCE PROVISIONS
14.1 It shall be the responsibility of Customer to provide accurate and
timely nominations of quantities proposed to be received and
delivered by Pipeline under all of Customer's Service Agreements
and to maintain, as nearly as practicable, equality between
quantities actually received by Pipeline and delivered to Customer
under each Service Agreement with Customer's scheduled quantities.
Customer shall cause the rate of deliveries to Pipeline at the
Point(s)of Receipt under a Service Agreement to equal, as nearly
as practicable, the rate of deliveries by Pipeline at the Point(s)
of Delivery under such Service Agreement. Upon notice by Pipeline
and/or issuance of an Operational Flow Order, such rates of
receipts or deliveries shall be adjusted within time periods as
specified by Pipeline in its notice or Operational Flow Order to
Customer. Failure to comply with a notice or Operational Flow
Order issued by Pipeline will make Customer subject to a penalty,
as set forth in Section 5.9(b) hereof.
14.2 Gas transported by Pipeline pursuant to any firm or interruptible
Rate Schedules will be received and redelivered on a thermally
equivalent basis as nearly as practicable at uniform hourly and
daily rates.
