GENERAL TERMS AND CONDITIONS (continued)
(n) Allocation Disputes: Allocation corrections or disputes
should be processed within six (6) months from the date of
the initial month-end allocations, unless (i) Transporter,
Shipper and the point operator mutually agree otherwise,
or (ii) the correction is the result of a deliberate
omission or misrepresentation by a Party or a mutual
mistake of fact. In all instances where a correction is
made, Transporter, Shipper or the point operator, as
applicable, shall have a 3 month rebuttal period. Parties'
other statutory or contractual rights shall not otherwise
be dimished by this standard.
3.5 Scheduling Priority for Transportation Quantities: Transporter
shall schedule receipts and deliveries of gas in the following
sequences:
(a) pro-rata among Transporter's firm transportation
customers, who nominated that point as a primary firm point
according to the quantities of gas scheduled by such
customers;
