Authorized Overrun Quantities: Transportation by
Transporter of Authorized Overrun Quantities shall be at
the applicable rate provided for in the IT Contract.
5.2 New Facilities Charge: In addition to the charges pursuant
to Section 5.1 of this Rate Schedule, Transporter shall
charge Shipper an amount to recoup the cost of facilities
constructed at the Shipper's request in order to provide
transportation service under this Rate Schedule.
Transporter shall not use the amounts so collected in
establishing its general system rates. The applicable New
Facilities Charge shall be stated in the IT Contract.
Transporter will construct only those facilities to render
transportation services hereunder which interconnect with
facilities that either cross or are immediately adjacent
to Transporter's existing facilities; provided, however,
Transporter shall not construct facilities hereunder which
will result in the expansion or diminishment of
Transporter's mainline capacity or which compromise the
operational integrity of Transporter's pipeline system.
Transporter will own and operate all facilities
constructed hereunder. Before designating an
interconnection as a Receipt or Delivery Point(s) for
service under this Rate Schedule, Transporter shall
require an agreement with the operator of the connecting
facility providing for the procedures governing
conformation of nominations and imbalances and allocation
of the gas quantities delivered to or received from
Transporter.
5.3 Incidental Charges: In addition to the charges pursuant to
Sections 5.1 and 5.2 of this Rate Schedule, Transporter
shall charge Shipper an amount to reimburse Transporter for
the amount of tax levied pursuant to the Alabama Utility
Gross Receipts Tax as recognized in the Commission's June
30, 1989 order in Alabama-Tennessee Natural Gas Co., Docket
Nos. CP88-269-004, et al., which have not been previously
paid by Shipper, which Transporter incurs in rendering
service hereunder. Transporter shall not use the amounts
so collected in establishing its
