Shipper's designee shown on Exhibit B to the IT Contract.
4.3 Transporter shall not be obligated to deliver gas pursuant
to this Rate Schedule to a Delivery Point that is operated
by a Shipper that has entered into an FT-SG Contract with
Transporter unless the FT-SG Shipper and the IT Shipper
have first complied with the provisions of Section 7 of
Transporter's FT-SG Rate Schedule.
4.4 Transporter shall not be required under any circumstances
to deliver gas to any Delivery Point(s) where the total
quantity of gas scheduled for delivery on any day is less
than that required for the accurate measurement of
quantities to be delivered.
4.5 Pressures: Shipper shall deliver gas to Transporter at the
pressure required from time to time to enable the gas to
enter Transporter's facilities at the Receipt Point.
Transporter shall deliver gas to Shipper or Shipper's
designee at Transporter's line pressure existing at the
Delivery Point(s).
4.6 Uniform Quantities: Shipper shall deliver and receive gas
in uniform hourly quantities during any day with no
significant fluctuation.
5. RATE
5.1 Applicable Rates: The rates for service under this Rate
Schedule is the applicable Maximum IT rate shown on the
effective Tariff Sheet No. 4; provided, however,
Transporter has the right at any time and from time to time
to adjust the rate applicable to any transportation service
upon notice to Shipper to any level not less than the
Minimum or more than the Maximum Rates established for this
Rate Schedule as set forth on the effective Tariff Sheet
No. 4.
Transporter shall file with the Commission the reports
required under Section 284.7 of the Commission's
Regulations for any adjustment below the Maximum Rates for
service under this Rate Schedule.
