gas received or delivered and ready verification of the accuracy of
measurement. Reasonable care shall be exercised in the installation,
maintenance and operation of any upstream or downstream pressure
regulating equipment which may be installed so as to avoid, so far as
practicable, any inaccuracy in the determination of the quantity of
gas received or delivered hereunder.
5.5 Failure of Meters
In the event a meter fails or is out of service, or registering
inaccurately by more than one percent (1%); the quantity of gas
received or delivered hereunder shall be estimated:
A. By using the registration of any check meter or meters if
installed and accurately registering, or, in the absence of
(A);
B. By correcting the error if the percentage of error is
ascertainable by calibration, test, or mathematical
calculation, or in the absence of both (A) and (B), then;
C. By estimating the quantity of receipts or deliveries during
periods under similar conditions when the meter was registering
accurately.
5.6 Test of Meters
The accuracy of Measurer's measuring equipment, including
chromatographs, shall be verified at least quarterly by routine tests
(or as otherwise agreed to by the parties), upon reasonable notice to
Non-Measurer, who shall have the right to witness. Non-Measurer
shall verify the accuracy of its check measuring equipment. In the
event either party notifies the other that it desires a special test
of any measuring equipment, the parties shall cooperate to secure
prompt verification of the equipment.
