guaranteeing refund to Shipper upon such bills after a final determination
by agreement, by determination of regulatory agencies having jurisdiction,
or by judgment of the courts, as may be the case. Payment of the disputed
portion shall not be deemed a waiver of the right to contest such disputed
portion in any forum having jurisdiction. Alternatively, shipper may, if
invoice is in dispute, pay portion not in dispute and provide
documentation identifying basis for dispute.
13.6 If it is determined that Shipper has been overcharged, and
Shipper has paid the statement containing the overcharge then, within 30
days after the final determination, TransColorado shall refund the amount
overcharged. If it is determined that Shipper has been undercharged,
Shipper shall pay the amount undercharged with appropriate interest within
30 days of notice by TransColorado of the amount. Prior period adjustment
time limits should be six months from the date of the initial
transportation invoice with a three month rebuttal period, excluding
government-required rate changes. This standard shall not apply in the
case of deliberate omission or mutual mistake of fact. Parties' other
statutory or contractual rights shall not otherwise be diminished by this
standard.
