9. USE OF RECEIPT AND DELIVERY POINTS (Continued)

9.6 Availability of receipt and delivery point information.

Shippers may obtain information through the Informational Postings portion

of TransColorado's Interactive Website regarding its ability to provide

transportation service at the receipt and delivery points desired by the

Shipper.

9.7 Discounted Transportation Rates. Unless inconsistent with the

transportation service agreement (or related discount agreement), a

Shipper may submit a request in writing to TransColorado that the discount

under that service agreement (or related discount agreement) be retained

at an alternate receipt or delivery point (whether through segmentation,

capacity release or exercise of flexible point rights).

TransColorado will respond on a reasonable efforts basis, to any

such request submitted by 4:00 p.m., CCT on a Business Day within two (2)

hours; provided that requests received between 4:00 p.m. CCT on a Business

Day and 9:00 a.m. CCT on the following Business Day will be deemed to have

been received by 9:00 a.m. CCT, and TransColorado will respond to such

requests by 11:00 a.m., CCT. Further, if the discount is to be effective

more than 24 hours in the future, TransColorado will respond within two

(2) Business Day or two (2) hours prior to the time timely nominations are

due for the day on which the discount is to be effective, whichever is

sooner. TransColorado's evaluation of the request will be based on the

similarly situated test. If TransColorado grants the request to provide a

discount at an alternate point where the existing contract does not cover

the applicable rate provision at that alternate point, the rate applicable

to the alternate point shall be the higher of the discount under the

service agreement (or related discount agreement) of the Shipper

requesting the discount or the discount being provided at the alternate

point to similarly situated Shippers.
