ELECTRONIC BULLETIN BOARD ACCESS AGREEMENT
This Agreement is entered into this __________ day of __________,
19__, between TransColorado Pipeline Company (TransColorado), 79 South State
Street, Salt Lake City, Utah 84111, and ____________ (Shipper).
The Parties represent as follows:
A. TransColorado has established an electronic bulletin board (EBB).
The EBB is an interactive information and transaction service accessible by
personal computer over a telephone line. The EBB allows shippers on
TransColorado's system to obtain information regarding available capacity on
TransColorado's system, to release and acquire capacity and to contract with
TransColorado for that capacity.
B. Shipper desires to obtain information from and/or transact
business with TransColorado using the EBB.
The Parties agree as follows:
1. Shipper shall have access to TransColorado's EBB through an access
code. TransColorado will assign the access code to Shipper. The access
code may be changed by TransColorado upon request by Shipper.
2. Before Shipper may transact business on TransColorado's EBB,
Shipper must comply with TransColorado's creditworthiness requirements set
out in TransColorado's FERC Gas Tariff, Original Volume No. 1 (Tariff).
Once Shipper has met TransColorado's creditworthiness requirements, Shipper
will be assigned a signature code that may be used to transact business on
TransColorado's EBB. Shipper will be bound by any transaction conducted on
the EBB using Shipper's signature code.
3. If Shipper transacts business on TransColorado's EBB, Shipper
agrees to be bound by all the terms and conditions of TransColorado's FERC
Gas Tariff, Original Volume No. 1. Each transaction on TransColorado's EBB
specifically incorporates TransColorado's Tariff, shipper's signature on
this agreement and the terms and conditions of this agreement, as the terms
and conditions of the transaction.
