3. RATE PROVISIONS (Continued)

(b) Usage Charge. Shipper shall pay the appropriate usage

charge for all gas nominated by Shipper and confirmed by TransColorado for

delivery. The usage charge shall be set forth in the Transportation

Service Agreement or any amendment and shall be no more than the maximum

nor less than the minimum rate specified in the Statement of Rates.

(c) Shipper shall reimburse TransColorado for fuel use and

lost-and-unaccounted-for gas in kind according to 12.11 of the General

Terms and Conditions of this tariff.

(d) Overrun Charges. Shipper shall pay all overrun charges

that may be assessed in accordance with this rate schedule and

TransColorado's Statement of Rates for all authorized or unauthorized

transportation service provided by TransColorado. Authorized Overrun

Charges will be subject to the maximum and minimum Rate Schedule IT usage

charges.

(e) Additional Facility Charge. Unless otherwise provided in

the Transportation Service Agreement or related documents, in the event

TransColorado and Shipper agree in writing that additional facilities are

necessary in order to implement the service contemplated under the

Transportation Service Agreement, Shipper agrees to reimburse

TransColorado for all costs, including the income tax costs, associated

with the construction and installation of such facilities which shall be

owned, operated and maintained by TransColorado.
