agreement, then TransColorado may impose the charges set forth in

Section 12.6. In addition, upon determination that such

unauthorized action has been taken by a Shipper, TransColorado may

take action to terminate such unauthorized use of its system.

 

13. BILLING AND PAYMENT

 

13.1 On or before the 25th day of each month, TransColorado shall

furnish to Shipper a monthly statement of the transportation

charge in effect and of the total payment due for the

transportation of gas during the preceding month (including any

other applicable charges). TransColorado shall provide a schedule

showing quantities of gas and heat content received and delivered,

including equivalent quantities, unaccounted-for gas, fuel gas and

any imbalance under Section 12. TransColorado may furnish an

estimated statement and make appropriate adjustments in the

statement rendered for the next succeeding month.

 

13.2 If capacity is released, the releasing Shipper will be billed the

reservation charges associated with the entire amount of the

releasing Shipper's CD. A conditional credit for the payment of

the reservation portion of the charges corresponding to the

released capacity will be applied to the releasing Shipper's bill.

The releasing Shipper will also be billed any negotiated marketing

fee.

 

TransColorado will bill the replacement shipper based on the rates

specified in the service agreement and any other applicable

charges. The replacement Shipper must pay the billed amount

directly to TransColorado.

 

If a replacement Shipper fails to pay TransColorado, TransColorado

will notify the releasing Shipper that the conditional credit has

been reversed and of the amount due, including interest calculated

in accordance with 18 C.F.R. Section 154.501(d). This amount must

be paid by the releasing Shipper. If the replacement Shipper

subsequently pays TransColorado, TransColorado will credit the

amount received to the releasing Shipper.

 

13.3 When information necessary for billing purposes is in the control

of Shipper, Shipper shall furnish such information to

TransColorado on or before the 10th day of
