transportation service agreement, nor may it be less than one gas
day.
6.9 Availability of Released Capacity - Released capacity shall be
made available on a nondiscriminatory basis and shall be assigned
based on the results of a bid period or a pre-arrangement
complying with the procedures described below.
6.10 Awarding of Contingency Bids - Released capacity subject to
contingency bids will not be awarded until the bidding shipper has
notified TransColorado, through TransColorado's EBB, that all
contingencies have been met. If all contingencies have not been
met by the deadline established by the releasing shipper, the
released capacity shall revert back to the releasing shipper
unless TransColorado has been directed otherwise.
6.11 Bid Period - No bid period shall be required for the following
transactions: (1) a pre-arranged release that (a) is for the
maximum applicable reservation charge, (b) is for the full term
for which the capacity is released and (c) meets all terms and
conditions of the release; and (2) a pre-arranged release for a
term of 31 days or less where the parties have negotiated and
posted to TransColorado's EBB a pre-arranged deal at the maximum
rate meeting all terms and conditions of the release.
A releasing shipper may post through TransColorado's EBB a pre-
arranged deal at the maximum rate to determine if another shipper
would be willing to offer better terms and conditions. All other
releases, except as indicated below, shall be subject to a bid
period conducted according to the following procedures:
(a) For pre-arranged releases (1) at the maximum reservation
charge and for the full term of the release or (2) for 31
days or less the releasing Shipper shall post notice of the
released capacity on TransColorado's EBB within 48 hours
after the transaction commences. However, a rollover of a
pre-arranged release of 31 days or less may occur only if
the parties negotiate and post on TransColorado's EBB a pre-
arranged deal at the maximum rate meeting all the terms and
conditions of the release.
