pre-arranged Shipper, TransColorado will post a notice on

its EBB.

(b) For pre-arranged service, if no better offer is received

during the bid period, the pre-arranged bidding Shipper

shall receive the capacity. If a bid is received with a

higher present value than the pre-arranged Shipper's bid,

the pre-arranged bidding Shipper shall have one day for a

short-term release and five days for a long-term release to

match the better bid. If the pre-arranged bidding Shipper

fails to match the better offer, the bidding Shipper who

presented the better offer shall receive the capacity.

5.13 Initial Deliveries. At the time service commences, TransColorado

will require Shipper to identify immediate upstream and downstream

transporters. TransColorado may also require Shipper to identify

any third-party transporter other than immediate upstream and

downstream third party transporters.

6. CAPACITY RELEASE AND ASSIGNMENT.

6.1 General. This section defines the terms and conditions of the

capacity release program on TransColorado's system and applies to

any Shipper that has contracted for firm transportation service

under this tariff and elects to release all or a portion of its

firm capacity.

6.2 Conditions of Release. A Shipper shall have the right to release

any portion of its firm capacity but only to the extent that the

released capacity is acquired by another Shipper through

provisions of this section.

6.3 Option to Withdraw Released Capacity.

(a) A releasing shipper may withdraw its offer to release

capacity prior to the close of the bid period if shipper

subsequently determines it needs the released capacity.

Otherwise, an offer to release capacity may not be

withdrawn.

(b) The releasing shipper must provide notice of its withdrawal

of released capacity through Transcolorado's EBB prior to

the close of the bid period.
