(xii) If Section 311 service is requested, a declaration
explaining how the requested service qualifies as
Section 311 service.
(xiii) The producing area (state) of the source of the gas
to be transported.
5.7 Bidding Conditions.
(a) The identity of any bidding Shipper shall be kept
confidential. However, the amount of each bid received by
TransColorado during the bid period will be posted on
TransColorado's EBB.
(b) A bid for firm capacity may be withdrawn; however, once a
bid is withdrawn, the bidding Shipper may not submit a new
bid for capacity at a lower rate.
(c) A bidding Shipper may not bid a reservation charge less than
the minimum reservation charge nor more than the maximum
reservation charge specified by the tariff, nor may the bid
exceed the quantity or the term specified by TransColorado.
(d) TransColorado shall not be obligated to accept any bid for
uncommitted capacity at a rate that is less than the rate
posted by TransColorado.
(e) TransColorado and Shipper will indicate acceptance of a
contract by electronically executing the agreement by use of
an electronic signature code. Shipper's use of its EBB
signature code on any EBB transaction screen is deemed to be
the party's consent to be bound by the transaction.
5.8 Request for Firm Service Fee.
(a) No prepayment fee is required if a Shipper bids for firm
service through TransColorado's EBB.
(b) If a Shipper bids for firm service, through a written
request, that Shipper must make a payment of the lesser of
$10,000 or the reservation charge for the requested CD for
the lesser of three months or the term of the requested
service. This reservation charge must be submitted
simultaneously with a Shipper's bid to:
