gas from the system during a month, including gas lost as a result
of an event of force majeure, the ownership of which cannot be
reasonably identified.
1.37 "Unauthorized overrun" means that quantity of gas by which Shipper
exceeds, without TransColorado's consent, Shipper's CD.
1.38 "Year" means a period beginning January 1 unless otherwise
specified of 365 consecutive days or 366 consecutive days if such
period includes February 29.
2. ELECTRONIC BULLETIN BOARD (EBB)
2.1 TransColorado will provide an EBB system to allow Shippers and
other interested parties access to pipeline information.
TransColorado's EBB will be available on a nondiscriminatory basis
to any party that has compatible computer equipment and
communication software and has entered into an access agreement
with TransColorado. The access agreement will allow any party to
access TransColorado's EBB to read, search, download and post
information and release and contract for service.
2.2 Access to TransColorado's EBB will be granted through use of a
first and last name and a password (access code) that will be
assigned and controlled by TransColorado. Each company will also
be assigned a signature code.
EBB users will be allowed to download and read data files and
bulletins through use of the access code. However, users must
provide their signature code before they will be allowed to insert
or update a record on the EBB online real-time access screens to
request, release or bid for capacity.
2.3 TransColorado will also provide the following as required by 18
C.F.R. Section 284.8 (b) (4).
(a) Daily backup of Information. TransColorado will maintain
backup copies of the data contained on its EBB for 3 years.
These copies may be archived to off-line storage but will be
provided on computer diskette for a charge of $50.00 to any
party requesting the information from the Director of EBB
Services.
(b) Current files will be purged of information regarding
completed transactions.
