on file with the FERC. The service agreement deviates from the form of

6/The Shipper's reservation charge is based on a fifty-percent load
factor. This requires the Shipper to pay a reservation charge on the
first 25,000 Dth per day multiplied by the number of days in the month,
regardless of flow. Once Shipper has satisfied the 50% load factor in any
month, the Shipper is only required to pay a transportation charge on the
volumes that flow. Shipper's reservation charge for the first 2,500,000
Dth transported will be $0.15/Dth ($4.5625 x 12 ö 365). At 2,500,001 Dth,
the Shipper's reservation charge will be reduced to $0.04/Dth ($1.2167 x
12 ö 365).
To the extent that the Southern Ute Tribe imposes any throughput fees for
operation of the supply lateral from the Antler Plant or an increase in
ROW fees, any such fees shall be borne by Shipper and shall be reimbursed
by Shipper to TransColorado.
7/Shipper's reservation charge is based on a thirty percent load factor.
This requires the shipper to pay a reservation charge of $0.25/Dth ($7.6042
x 12 ö 365) on the first 136,800 Dth per month, regardless of flow. At
136,801 Dth or more, the shipper is only required to pay this reservation
charge on volumes that flow.
