FSS RATE SCHEDULE
FIRM STORAGE SERVICE (Continued)
FSS Agreement with the qualified successor customer who submitted the
bid.
10.3 Continuation of Service. If, during the open season, Petal receives no
bids or rejects all bids, Petal and the current capacity holder may
negotiate for continuation of service under mutually satisfactory rates,
terms, and conditions. In no event, however, will such continued service
be provided at a rate lower than the highest rate bid by a qualified
prospective successor customer during the open season.
11. EXPIRATION OF TERM
At least thirty (30) business days prior to the end of the primary term or any
renewed term of the Customer's FSS Agreement, Petal shall notify Customer to
withdraw all of the FSS gas quantities held in storage by Petal for the account
of Customer. If Customer fails to withdraw such FSS storage gas by the end of
the term, then Petal may take, free and clear of any adverse claims, title to
such FSS storage quantities as Customer was required to withdraw. Petal's
notice to Customer may be given verbally, but shall be confirmed in writing
either by fax or via Petal's EBB.
12. GENERAL TERMS AND CONDITIONS
Applicable provisions of the storage service General Terms and Conditions of
this Tariff, as such provisions may be amended from time to time, are hereby
incorporated by reference and made a part of this FSS Rate Schedule, where
applicable, and shall supplement the terms and conditions governing service
rendered hereunder, as though stated herein; provided, however, that in the
event of any inconsistency, the terms of this FSS Rate Schedule shall control.
