(2) If any marketer affiliated with Transporter is
buying and reselling any of the gas requested to be
transported, whether and by how much the cost of the gas
to the affiliated marketer exceeds the price received for
the sale of the gas by the affiliated marketer, after
deducting associated costs including those incurred for
transportation.
(l) Certification From On-Behalf-Of Entity - If Shipper
is requesting service hereunder to be implemented pursuant to
Subpart B of Part 284 of the Commission's regulations, Shipper
must provide certification that a local distribution company or
an intrastate pipeline company, as those terms are defined in
the Natural Gas Policy Act of 1978, on whose behalf the
transportation will be performed (i) has physical custody of and
transports the natural gas at some point; or (ii) holds title to
the natural gas at some point, which may occur prior to, during,
or after the time that the gas is being transported by
Transporter, for a purpose related to its status and functions
as a local distribution company or its status and functions as
an intrastate pipeline company, or (iii) that the gas is being
delivered at some point to a customer that either is located in
a local distribution company's service area or is physically
able to receive direct deliveries of gas from an intrastate
pipeline, and that local distribution company or intrastate
pipeline certifies that it is on its behalf that Transporter is
providing transportation service.
(m) Compliance with Tariff - Shipper shall submit a
statement that it is willing to abide by the terms of
Transporter's applicable rate schedule, including the
Transportation General Terms and Conditions. Shipper shall
further state that it is willing to pay the maximum rate
provided for under Transporter's applicable rate schedule. If
Shipper is unwilling to pay such maximum rate, Shipper shall
specify the rate it is willing to pay, but Shipper's request
shall not be deemed valid until the date on which Shipper and
Transporter agree in writing on such lower rate.
