1. AVAILABILITY (Continued)
(b) If Transporter is required to construct, modify, expand
or acquire any facilities; provided, however, that Transporter may
elect in its reasonable discretion to construct, modify, expand or
acquire facilities to enable it to perform such services; or
(c) If Shipper has not provided Transporter with the
information required in Section 12 of the Transportation General
Terms and Conditions.
1.4 Transporter may also reject any request, or limit the term
of the Transportation Service Agreement requested by Shipper, if
Transporter, in its reasonable judgment, determines that the service
requested would utilize a portion of Transporter's system such that a
bottleneck would be created that would likely prevent Transporter from
utilizing upstream or downstream portions of its system, thus rendering
Transporter unable from providing substantial services for others
utilizing such upstream and downstream portions of the system.
2. APPLICABILITY AND CHARACTER OF SERVICE
2.1 This rate schedule shall apply to the transportation of gas
by Transporter pursuant to a Transportation Service Agreement executed
by Transporter and Shipper providing for transportation service each
day on an interruptible basis up to the Maximum Daily Transportation
Quantity (MDTQ) and shall be subject to the provisions of the
Transportation Service Agreement and the Transportation General Terms
and Conditions of this Volume No. 1-A Tariff. Transportation service
performed under this rate schedule shall be performed under Subparts B
or G of Part 284 of the Commission's regulations.
