(3) In the event Customer does not submit a timely
nomination or desires to alter a timely nomination,
Customer shall have the right to submit an intra-day
nomination to revise Customer's scheduled quantities,
Point(s) of Receipt, and/or Points(s) of Delivery on a
prospective basis prior to the end of the delivery day;
provided, however, that such intra-day nomination will
be processed after timely nominations have been
scheduled. Such intra-day nomination shall, subject to
Section 17 and 4.1(J)(1) of the General Terms and
Conditions, be implemented by Pipeline to the extent
and only to the extent that Pipeline is able to confirm
the receipt and delivery of such gas at the Point(s) of
Receipt and Point(s) of Delivery and only if the
scheduling of such intra-day nomination will not
require the Systematic Rescheduling of Pipeline's
capacity among previously scheduled service agreements
in order to provide capacity for said intra-day
nomination. Such intra-day nomination shall specify
Customer's service requirements for one day only and
shall include the effective date and time. Intra-day
nominations do not replace the remainder of a standing
nomination. There is no need to re-nominate if an
intra-day nomination modifies an existing nomination.
The interconnected parties shall agree on the hourly
flows for the intra-day nomination.
(4) When a nomination for a date range is received, each
day within that range is considered an original
nomination. When a subsequent nomination is received
for one or more days within that range, the previous
nomination is superseded by the subsequent nomination
only to the extent of the days specified. The days of
the previous nomination outside the range of the
subsequent nomination are unaffected. Nominations have
a prospective effect only.
