(h) Releasing Customers, Potential Customers, or Prearranged

Customers shall indemnify Pipeline from and against any and

all losses, damages, expenses, or penalties of any and/or

every kind and character which Pipeline or such Releasing,

Potential, or Prearranged Customer may suffer, sustain, or

be liable, and Pipeline shall be held harmless by Releasing

Customers, Potential Customers, or Prearranged Customers

from and against any and all damages, claims, suits,

actions, or proceedings whatsoever threatened or initiated

as a result of Pipeline's selection of the "best offer."

 

(i) Upon receipt by pipeline of multiple bids meeting minimum

conditions, Pipeline shall award bids, best bid first, until

all offered capacity is awarded.

 

(j) Releasing Customer(s) may, to the extent permitted as a

condition of the capacity release, recall released capacity

(scheduled or unscheduled) at the Timely Nomination Cycle

and the Evening Nomination Cycle, and recall unscheduled

released capacity at the Intraday 1 and Intraday 2

Nomination cycles by providing notice to Pipeline by the

following times for each cycle: 8 a.m. CCT for the Timely

Nomination cycle; 5:00 p.m. CCT for the Evening Nomination

Cycle; 8:00 a.m. CCT for the Intraday 1 Nomination Cycle,

and 3:00 p.m. CCT for the Intraday 2 Nomination Cycle.

Notification to Replacement Customer(s) shall be provided by

Pipeline within one hour of receipt of recall notification.
