With respect to the processing of requests for decreases during
the Evening, Intraday 1 or Intraday 2 Nomination Cycles, in the
absence of agreement to the contrary, the lesser of the
confirmation quantities should be the new confirmed quantity, but
in any event no less than the elapsed-prorated-scheduled quantity.
If there is no response to a Request For Confirmation or an
unsolicited Confirmation Response, the greater of the confirmation
quantity or the elapsed-prorated-scheduled quantity should be the
new confirmed quantity.
Transporter shall notify Shipper of the quantities of gas
confirmed for receipt from and delivery to or for the account of
Shipper. In the event of an inability of Transporter to obtain an
upstream or downstream confirmation, Transporter may notify
Shipper of such lack of confirmation contact in order that
confirmation may otherwise be obtained.
Transporter reserves the right to verify that the quantities of
gas, requested by the Shipper, are flowing as confirmed and
scheduled by the Transporter and to interrupt receipt or
deliveries pursuant to an Operational Flow Order under Section
17C.3 to the extent such quantities are not flowing as scheduled.
C. Scheduling
The term "Scheduling" herein refers to the allocation of available
capacity among confirmed nominations for each day on Transporter's
system, as set forth below.
