GENERAL TERMS AND CONDITIONS

23. NOTICES

Unless otherwise specified in this Gas Tariff or any service agreement

thereunder, any notice, request, demand, statement or bill provided

for in this Gas Tariff or any service agreement thereunder, or any

notice which either WNG or Shipper may desire to give to the other,

shall be in writing and if delivered shall be considered as duly

delivered when mailed to the Post Office address of the other party or

to such other address as either shall designate by formal written

notice, or when delivered by such other method mutually agreed upon by

the parties. Alternatively, when agreed to in writing by the parties,

routine communications may be transmitted by facsimile or electronic

data interchange.

24. CONSTRUCTION OF SALES LATERAL PIPELINES TO RESALE CUSTOMERS

WNG will not be obligated to build or contribute to the cost of

building any sales lateral pipelines.

Nothing in this policy statement shall require WNG to file an

application for a certificate of public convenience and necessity

under Section 7(c) of the Natural Gas Act. Nothing in this policy

statement, further, shall prevent WNG from contesting an application

for service filed pursuant to Section 7(a) of the Natural Gas Act.

WNG reserves the rights to seek a waiver of the policy set forth

herein, for good cause shown, during any proceeding before the Federal

Energy Regulatory Commission instituted under Section 7 of the Natural

Gas Act.
