applicable to the sale and/or transportation of natural
gas to Shipper.
17.2 Term of Service Contract: The term of any executed
Service Contract shall be as mutually agreed upon by
Shipper and Transporter and shall not exceed twenty
(20) years.
18. DELIVERY LATERAL PIPELINE POLICY
18.1 Transporter will, upon receiving proper authorization
deemed requisite and satisfactory by Transporter, and
upon the execution of a satisfactory Service Contract,
expand, enlarge, or augment its existing delivery
lateral pipelines on a non-discriminatory basis.
18.2 Nothing in this policy statement shall require
Transporter to file an Application for a Certificate of
Public Convenience and Necessity under Section 7(c) of
the Natural Gas Act. Nothing in this policy statement,
further, shall prevent Transporter from contesting an
application for service filed pursuant to Section 7(a).
Transporter reserves the right to seek a waiver of the
policy set forth herein, for good cause shown, during
any proceeding before the Commission instituted under
Section 7 of the Natural Gas Act.
19. ODORIZATION
Gas delivered by Transporter will be delivered in its
natural state without the addition of any odorizing agent,
and Transporter does not by such delivery assume any
obligation for damages, claims, or liabilities by reason of
the fact that it has not odorized such gas prior to its
delivery.
