(c) above shall be scheduled by Transporter provided that: (i)
Transporter and all affected parties mutually agree to schedule
the late nomination, and (ii) the scheduling of such late
nomination does not bump a nomination received prior to the
nomination deadlines referenced above.
(i) Nomination Confirmations: The receiver of a nomination
initiates the confirmation process. The party that would
receive a Request for Confirmation or an unsolicited
Confirmation Response may waive the obligation of the sender to
send. Transporter shall complete the confirmation process for
chart-time nominations by 3:30 p.m. CCT the day prior to the
nomination start date. Where discrepancies in quantities exist
between confirming parties, the confirmed quantity shall be the
lesser of the nominated quantity (inclusive of any reductions
related to capacity allocation) or the confirmed quantity.
Where no communication is received, the lesser of the
nomination (inclusive of any reductions related to capacity
allocation) or the previously scheduled quantity applies.
(j) Scheduling Limitation: No transportation service shall
commence unless and until Transporter and the point operator(s)
at the Receipt and Delivery Point(s) through which Shipper
desires to receive service have received the information
requested in the Customer Nomination Form and Transporter is
able to schedule the receipt and delivery of such service at
the Point(s)of Receipt and Point(s) of Delivery and Transporter
has made a determination that sufficient capacity is available
so that such transportation service can be performed.
