with said order or decree continuing unstayed and in
effect for a period of sixty (60) consecutive days.
3.3 (a) An FT Contract shall be executed by Shipper and
Transporter following Transporter's acceptance in
writing of Shipper's request for service. In the
event the FT Contract is not executed and returned by
Shipper within thirty days after Transporter tenders
the FT Contract, Transporter shall consider the
request for service invalid.
(b) If the gas to be transported is not for Shipper's
system supply, or its ultimate end use, then on or
before the date the FT Contract is executed Shipper
shall (i) identify the name of the corporate entity or
entities which will ultimately receive the gas to be
transported and (ii) provide verification that the
identified ultimate recipients have executed sales
contracts related to the transportation services to
be provided under the FT Contract.
4. DELIVERY AND RECEIPT POINTS; PRESSURE; UNIFORM QUANTITIES
4.1 Receipt Points: The Primary Receipt Point(s) for all gas
transported by Transporter under this Rate Schedule shall
be at a mutually agreeable interconnection between
Transporter's facilities and the facilities of the
upstream pipeline system providing service as shown in
Exhibit A to the FT Contract. The total quantity specified
at the Primary Receipt Point(s) must equal the sum of the
Contract Demand and Fuel and Losses requirement set forth
in Section 6 of this Rate Schedule. Transporter shall not
be required under any circumstances to receive gas at any
Receipt Point(s) where the total quantity of gas scheduled
for receipt on any day is less than that required for the
accurate measurement of quantities to be received.
