5.5 Delivery Nominations and Scheduling (continued)
Delivery to be allotted among all suppliers at such point on
a pro rata basis based on the quantity nominated from each
supplier. Transporter may thereafter require the submission
of other information as is reasonably necessary to complete
the processing of the nominations. Overrun quantities
should be requested on a separate transaction. Nominations
not properly completed or submitted may be rejected or, to
the extent possible, partially scheduled by Transporter.
(c) Limitation: For any given time period, each Shipper's
maximum nomination shall not exceed, without Transporter's
consent, Shipper's Maximum Contract Quantity, Contract
Limitations, Maximum Injection and Deliverability
Quantities, and Interruptible Maximum Daily Injection and
Interruptible Maximum Daily Withdrawal Quantities, as
applicable. Shipper shall use its best efforts to avoid
receiving quantities of Gas which differ or deviate from
the quantities of Gas scheduled or nominated by Shipper for
delivery, and shall keep Transporter advised of any
material deviations in the actual quantities delivered from
the quantities scheduled. In the event there is a
discrepancy between the amount nominated by Shipper at a
Delivery Point and the amount the entity which controls the
facilities immediately downstream of the Delivery Point
will confirm, the provisions of NAESB Standard 1.3.22 will
govern.
