Points Points

(1) Rate applicable to all overrun quantities, whether authorized or unauthorized.

(2) Shipper entering into companion Rate Schedule HFT transaction for one sixty (60) consecutive day period beginning January 1, 2001; and two ninety (90)

consecutive day periods beginning December 1, 2001 and December 1, 2002, respectively. Pursuant to Section 15, GT&C, of Transporter's Tariff, Transporter providing

limited waivers of advance and electronic contracting requirements to facilitate such transaction. Shipper has right to permanently reduce its HFT Contract

Demand, in whole or in part, if it provides notice to Transporter by the September 30 immediately preceding the applicable December 1.

(3) Shipper agrees to utilize service under the above-described FT and HFT contracts to transport all of its plant requirements for natural gas to the extent such

service is made available by Transporter.

(4) GRI (only to the extent the charge is voluntary and discountable prior to any other component of the rate), ACA, GT&C Section 13.4, Order No. 528 and Order

No. 636 transition costs surcharges shall not be utilized to charge amounts in excess of the authorized overrun rate.
