(b) It is Stingray's intent that the accounting set forth

in Section 36.4(a) hereof shall operate as a true-up

mechanism between Stingray's (1) Eligible Costs and

(2) Event Surcharge revenue plus Insurance Recoveries

and other recoveries from third parties of Eligible

Costs previously included in the Event Surcharge Cost

Account.

36.5 CALCULATION OF THE EVENT SURCHARGE

(a) The Event Surcharge shall equal:

(1) The latest available balance in the Event

Surcharge Cost Account, divided by

(2) The projected total system throughput

(unadjusted for any rate discounting) for the

12-Month period beginning on the proposed

effective date of the applicable Event

Surcharge.

(b) In no event shall the Event Surcharge exceed

$0.02/Dth. In calculation of the Event Surcharge in

each separate filing pursuant to Section 36.3(a)

hereof, the collection of any Eligible Costs included

for recovery in such filing shall be amortized over a

36 Month period; provided, however, that if the Event

Surcharge as calculated in accordance with the

foregoing is less than $0.005/Dth, Stingray may

amortize the amount in the Event Surcharge Cost

Account over 12 Months.

(c) To the extent that any portion of the Event Surcharge

Cost Account remains uncollected at the end of a given

period as a result of the $0.02/Dth cap or the 36

Month amortization period, the foregone revenue plus

carrying costs at the FERC-prescribed interest rate

may be collected by Stingray in a subsequent period.

(d) If the amount in the Event Surcharge Cost Account is

less than $100,000 (either negative or positive),

Stingray may, upon at least thirty (30) Days prior

notice to the Commission, reduce the Event Surcharge

to $0.00/Dth and refund to or bill Shippers the amount

in the Event Surcharge Cost Account in the invoice for

the Month following the date the Event Surcharge is

reduced to $0.00/Dth based on the actual quantities

received by Stingray for each Shipper during such

Month.
