Examples of Eligible Costs include but are not limited to actual
costs associated with: temporary or permanent pipeline re-
routings; repair or replacements of pipeline (including but not
limited to Event-related damage caused by dragging of shipping
anchors and damage to third parties caused by Event-related damage
to Stingray), receipt points, delivery points, compressors,
buildings, fences and other property and appurtenant equipment
used by Stingray to provide jurisdictional service; construction
of replacement or alternative, or remediation of existing,
pipeline interconnections or multiple pipeline crossings and
associated facilities; removal of pipelines and other equipment
(including but not limited to removal of Stingray's equipment on
offshore platforms owned by third parties); removal of debris
(including but not limited to sunken ships and platforms);
pipeline burials; smart pigging operations related to an Event;
post-storm inspections (including but not limited to inspections
by remote operated submersible vehicles and inspections required
by any governmental authority); reimbursement of damage to third
party property and persons; miscellaneous expenses associated with
having personnel available to repair Stingray's system; and other
storm-related incremental costs related to an Event resulting from
federal, state and/or local regulation; provided, however, the
term "Eligible Costs" shall in all cases include only actual costs
incurred to repair damage and/or recover system operations related
to an Event.
36.3 FILING PROCEDURES
(a) Except for the first Event Surcharge filing which was
made with Stingray's rate case filing on June 30,
2008, and the first revised Event Surcharge included
in the settlement in FERC Docket No. RP08-436,
Stingray shall file by September 1 and March 1 of each
Year to establish the Event Surcharge to be effective
October 1 and April 1, respectively, of each Year. The
Event Surcharge shall be shown on Stingray's FERC Gas
Tariff Sheet No. 5.
(b) With each Event Surcharge filing, Stingray shall
include detailed information on the Eligible Costs
included in the filing and a written explanation of
how each such cost qualifies for reimbursement through
the Event Surcharge pursuant to this Section 36. Each
Event Surcharge filing shall also include (1) all the
revenues Stingray has collected through the Event
Surcharge, (2) all the Eligible Costs Stingray has
incurred, and (3) any Insurance Recoveries and other
recoveries from third parties of Eligible Costs
previously included in the Event Surcharge Cost
Account, for each Month during the period beginning on
the date immediately following the last Month for
which such information has been provided in a previous
Event Surcharge filing and ending on the same date of
the Event Surcharge Cost Account balance used by
Stingray in the Event Surcharge filing.
