13. SCHEDULING AND CURTAILMENT (continued)
13.4 Curtailment Liability. Steckman Ridge shall not be liable for any
loss or damage to any Customer, person or property caused, in
whole or in part, by any curtailment, interruption, or
discontinuation of service invoked by Steckman Ridge, which shall
include any curtailment described in any part of Section 13.5,
except to the extent caused solely by Steckman Ridge's gross
negligence or willful misconduct.
13.5 Scheduled Maintenance.
(a) Steckman Ridge shall have the right to curtail, interrupt or
discontinue service in whole or in part on all or a portion
of its facilities from time to time to perform inventory
verification processes, repairs, maintenance or improvements
of Steckman Ridge's facilities as necessary to maintain the
operational capability of Steckman Ridge's facilities or to
comply with applicable regulatory requirements, or to
perform construction pursuant to valid Commission
authorization. Steckman Ridge shall exercise due diligence
to schedule inventory verification processes, repairs,
maintenance and construction so as to minimize disruptions
of service to Customers and shall provide reasonable notice
of the same to Customers.
(b) Force Majeure. Steckman Ridge shall have the right to
curtail, interrupt, or discontinue service in whole or in
part on all or a portion of its facilities at any time for
reasons of Force Majeure pursuant to Section 29 of these
General Terms and Conditions.
