1/ Beginning on the earlier of the U.S. Pipeline and Hazardous Materials Safety Administration's Approval Date or the Pre-Approved Expansion Capacity Date, as

defined in the Agreement, through the date ten (10) years thereafter; provided if the term of the transportation agreement has not commenced by January 1, 2012,

the Negotiated Rate Term shall be considered null and void.
