6. CAPACITY RELEASE AND ASSIGNMENT

6.1 General. This section defines the specific terms and conditions

of the capacity release-program on White River's system and applies to any

Shipper that has contracted for firm transportation service under Rate

Schedules FT and RGS and elects to release all or a portion of its firm

transportation capacity.

6.2 Release of Capacity Under Rate Schedule RGS. In the case of any

release of capacity by a Shipper under Rate Schedule RGS, the Replacement

Shipper shall execute an agreement for service pursuant to, and shall receive

service subject to the terms and conditions of, Rate Schedule FT.

6.3 Criteria for Evaluating Bids for Released Capacity. A releasing

Shipper may specify how bids for released capacity are to be evaluated to

determine the best offer. A Releasing Shipper must notify White River of the

criteria by which volumetric bids are to be evaluated. These criteria must be

objectively stated, applicable to all potential bidders and nondiscriminatory.

Unless the offer to release is withdrawn according to § 6.23, the Releasing

Shipper shall not be entitled to reject a bid that meets its specified

criteria.
