6. CAPACITY RELEASE BY FIRM SHIPPERS (Continued)
6.11 Confirmations; Released Firm Transportation Agreement. At the
time the award of capacity under this Section 6 is posted, TransColorado shall
send the winning Qualified Bidder or the Prearranged Shipper confirmation of
the capacity release awarded to such Qualified Bidder or Prearranged Shipper.
Prior to TransColorado awarding capacity on a Prearranged Release, the
Prearranged Shipper shall confirm electronically the terms of the Prearranged
Release.
6.12 Completed Transactions. By 5:00 p.m. CCT after capacity has been
awarded, TransColorado shall post on its Interactive Website the name(s) of
the winning Qualified Bidder(s), identification of the winning Qualified
Bid(s) and any minimum bid conditions held confidential during the open
season. The Releasing Shipper is responsible for reviewing the Qualified Bids
to ensure that the released capacity was correctly awarded. The Releasing
Shipper shall notify TransColorado of any error in the award of capacity
within one business day after such posting on the Interactive Website. In the
event of an error, the capacity shall be reawarded by TransColorado. As
between TransColorado and the Releasing Shipper, the Releasing Shipper shall
indemnify and hold TransColorado harmless as to any costs, damages or expenses
relating to the bid evaluation procedure for which timely notice of an error
was not provided to TransColorado by the Releasing Shipper hereunder.
TransColorado shall correct an error in a timely fashion after receiving
notice of such error from the Releasing Shipper or another person.
6.13 Billing
(a) TransColorado shall bill the Replacement Shippers and the
Subreplacement Shippers the rate(s) specified in the Released Firm
Transportation Agreements and any other applicable charges and each such
Replacement Shipper and Subreplacement Shipper shall pay the billed amounts
directly to TransColorado. TransColorado shall not be responsible for billing
the Replacement Shipper for any amounts attributable to gas purchase volumes
tied to a transportation capacity release. Such charges shall be between the
Releasing Shipper and Replacement Shipper. TransColorado will support
volumetric releases with volumetric commitments by fully accounting for
volumetric and reservation components, consistent with the rules and
regulations enunciated by the Federal Energy Regulatory Commission.
