(f) Execution of Agreements. A prospective Customer allocated storage capacity in an open
season shall be required to execute one or more Storage Service Agreements for Firm
Storage Service no later than 30 consecutive days following the close of the open
season or forfeit the service that has been allocated to it.
(g) Firm storage capacity that is or becomes available in ASC's facilities for which ASC
determines, pursuant to Section 3.1(a) above, that an open season will not be held
shall be posted on ASC's Internet Web Site pursuant to Section 284.13(d)(1) of the
Commission's regulations and shall be allocated on a first-come, first-served basis
to the first prospective Customer offering to pay a rate and offer a term of service
that ASC finds acceptable. From time to time, ASC may negotiate with Customers for
prearranged storage service for a future period or for interim service. ASC will
post information regarding available storage capacity on its Internet Web Site before
it provides such information to any potential Customer.
(h) Nothing in this Section 3.1 shall in any way preclude ASC from conducting an open season
more than one (1) year before newly constructed capacity will be available for service
and awarding such capacity to the highest bidders through execution of precedent
agreements for the capacity. Any capacity covered by a precedent agreement shall not
be subject to the open season under this Section 3.1 unless the conditions precedent
in such an agreement are not timely fulfilled or the precedent agreement is otherwise
terminated.
3.2 Requests for Service. Any prospective Customer wishing to obtain service from ASC shall
submit in writing to ASC a request for service in substantially the same format as that
shown in Section 33. Such request may be delivered in person or submitted by United
States mail, overnight courier service, or facsimile transmission (fax). ASC shall
evaluate and respond to prospective Customer's request within five (5) Business Days of
its receipt. If ASC and prospective Customer mutually agree to the rates prospective
Customer will pay for service, ASC shall, subject to execution of a Storage Service
Agreement, endeavor to provide service within the time specified in the written request.
Prospective Customer's request for service shall be considered complete only if the
information specified in Sections 3.3 and 3.4 of these General Terms and Conditions
is provided in writing.
