[Where Transporter and Shipper agree that their service agreement

will be subject to the provisions of Section 11 of the General Terms and

Conditions, the following provision will be inserted:

Transporter and Shipper agree that this Agreement shall be

treated as a Qualifying Agreement for purposes of Section 11 of

the General Terms and Conditions.]

[In the case of a service agreement that is not a Qualifying

Agreement under Section 11.1 of the General Terms and Conditions by virtue of

Section 26.5 or Section 36 thereof, the following provision will be inserted:

Transporter and Shipper agree that this Agreement shall not be

treated as a Qualifying Agreement for purposes of Section 11 of

the General Terms and Conditions.]
