(xviii) whether Potential Shippers will be required to pay for

the capacity to be released at a rate (not to exceed

Transporter's maximum applicable rate) based on

published index prices for specific receipt and/or

delivery points or other agreed upon published pricing

reference points, consistent with Section 39(f) of these

General Terms and Conditions.

(b) Offers are binding until written or electronic notice of

withdrawal is received by Transporter. The releasing party may

withdraw its offer during the bid period where unanticipated

circumstances justify and no minimum bid has been made. The

withdrawal must be via written notice, facsimile transmission

or through E-Mail, or via EDM, including an affidavit

establishing unanticipated circumstances justifying the

withdrawal. A Shipper's Notice of a Prearranged Deal

transmitted via EDM must be withdrawn via EDM.
