GENERAL TERMS AND CONDITIONS
16. NOTICES
Except when Transporter's General Terms and Conditions require it to give notice
through its Internet website, any communication, notice, request, demand,
statement or bill provided for in this Tariff or in a gas service agreement, or
any notice that either Transporter or Shipper may desire to give to the other,
shall be in writing and shall be considered as duly presented, rendered or
delivered when mailed by post-paid registered or ordinary mail or when sent by
electronic medium or such other method mutually agreed upon between the parties.
The material so sent shall be addressed to the pertinent party at its last known
post office address, or at such other address as either party may designate.
17. MODIFICATION
No modification of the terms and provisions of an executed gas service agreement
shall be made except by the execution of a superseding gas service agreement or
the execution of a superseding exhibit thereto.
18. NONWAIVER AND FUTURE DEFAULT
No waiver by either Transporter or Shipper of any one or more defaults by the
other in the performance of any provision of a gas service agreement shall
operate or be construed as a waiver of any future default or defaults, whether of
a like or of a different character.
19. APPLICABLE REGULATIONS
This Tariff, including these General Terms and Conditions, and the respective
obligations of the parties under the gas service agreements are subject to valid
laws, orders, rules and regulations of duly constituted authorities having
jurisdiction and are subject to change from time to time by addition, amendment
or substitution as provided by law.
20. OPERATING INFORMATION AND ESTIMATES
At Transporter's request, any Shipper shall furnish to Transporter estimates of
peak day, monthly and annual quantities of natural gas (by classification of
customers as required by the Federal Energy Regulatory Commission's Regulations).
In addition, Shipper shall furnish Transporter with comparable actual gas sales
and end-use data relating to the ultimate consumer(s) on Transporter's system.
