25.6 Liability for Use of Pine Needle's EBB

A Pine Needle's EBB subscriber assumes sole responsibility for use of

Pine Needle's EBB and the files and the information displayed on Pine

Needle's EBB and hereby indemnifies and holds Pine Needle harmless

against any liability or claim of any person that is attributable to

improper use by the Pine Needle's EBB subscriber of Pine Needle's EBB

or of the files and the information displayed on Pine Needle's EBB.

Except as may result from the negligent action or willful misconduct

of Pine Needle, Pine Needle shall have no responsibility to Pine

Needle's EBB subscribers or to any third party for faulty retrieval,

failure of retrieval, or loss of research, and in no event will Pine

Needle be liable to a Pine Needle's EBB subscriber or to any third

party for actual, consequential, exemplary, or special damages

resulting, in whole or in part, from the Pine Needle's EBB

subscriber's use of Pine Needle's EBB and the files of and the

information displayed on Pine Needle's EBB. If a Pine Needle's EBB

subscriber requests and receives assistance from Pine Needle's

employees, such assistance will be at the Pine Needle's EBB

subscriber's sole risk and Pine Needle will not have any

responsibility or liability arising therefrom, except as may arise

from the negligent action or willful misconduct of Pine Needle.
