25.3 Maintenance of Public Information
Public information displayed on Pine Needle's EBB will be displayed in reverse
chronological order. Information concerning completed capacity release transactions
will remain on Pine Needle's EBB for at least ninety (90) days after completion and
will be archived after such transactions are no longer actively maintained on the
system. Archived information will be made available by Pine Needle within a
reasonable period of time after a customer's request for such information, and Pine
Needle may charge a reasonable fee for providing such archived information. Pine
Needle shall maintain and retain back-up records of the information displayed on Pine
Needle's EBB for no less than three (3) years.
25.4 Electronic Execution of Agreements
(a) To the extent that Pine Needle provides through Pine Needle's EBB the ability for
subscribers to execute service agreements, electronic execution of such
agreements shall be the sole method utilized by subscribers to enter into such
agreements. Pine Needle will maintain on Pine Needle's EBB a list of those
service agreements that shall be executed electronically by Pine Needle's EBB
subscribers.
(b) As its signature on an electronically executed agreement, a subscriber shall
either (a) enter the name(s) of persons designated as having the authority to
enter into agreements in electronic form on the subscriber's behalf or (b) follow
such other procedures as the subscriber and Pine Needle have mutually agreed in
writing shall constitute the subscriber's signature. Entry of such signature
shall be sufficient to verify that the subscriber executed such agreement.
(c) An electronically executed agreement shall not be deemed to have been properly
received until accessible to Pine Needle through Pine Needle's EBB. Any such
agreement which has been received shall not give rise to any obligation unless
and until Pine Needle has provided in return its notice of acceptance of the
agreement. Pine Needle's notice of acceptance of the agreement shall constitute
Pine Needle's signature, and shall be sufficient to verify that Pine Needle
executed such agreement.
