(b) Releasing Shipper shall post the Shipper Notice on the Web

the bid period, where unanticipated circumstances justify

and no minimum bid has been made.

(d) The terms Releasing Shipper imposes may not conflict with

any provision of the Transportation Agreement, Rate Schedule

or General Terms and Conditions. In the event of such

conflict, Transporter may withdraw the Shipper Notice from

20.3 Exceptions to Bidding

(a) The following pre-arranged releases are exempt from the

bidding process set forth in Section 20.4 herein: (i)

releases to an asset manager as defined by FERC regulations

at 18 C.F.R. Section 284.8; (ii) releases to a marketer

participating in a state-regulated retail access program as

defined by FERC regulations at 18 C.F.R. Section 284.8;

(iii) releases for more than one year at the maximum rate;

and (iv) releases with terms of thirty-one (31) days or

less, except rollovers. All other capacity releases shall

be subject to the bidding process set forth in Section 20.4.
