4.16 Any notice, statement, or bill provided for in the Agreement shall

be in writing and shall be considered as having been given if hand

carried, transmitted electronically (including facsimile

transmissions and computer transmissions), or if mailed by United

States mail, postage prepaid, to the address contained in the

Agreement.

 

4.17 Governmental Regulation. The Transportation Service Agreement is

subject to present and future valid orders of duly constituted

authorities having jurisdiction over the subject matter thereof.

Upon cessation of such jurisdiction or control, all rights and

obligations set forth in the Transportation Service Agreement

shall continue in effect.

 

4.18 Assignment

 

(a) Assignable Parties. This Agreement may be assigned by either

of the Parties to:

 

(i) any person, firm, or corporation acquiring all, or

substantially all, of the natural gas business of said

Party;

 

(ii) a trustee or trustees, individual or corporate, as

security for bonds or other obligations or securities;

but it may not be otherwise assigned without the

consent of the other Party hereto. Whenever any

corporation is referred to herein, such reference

shall be deemed to include the successors and

assignees of such corporation.

 

(b) Assignment. This Agreement shall be binding upon and inure to

the benefit of the successors and assignees of each of the

Parties hereto.

 

(c) Clarification of Use. Unless expressly allowed by Transporter

in writing, Transportation Service for other than the

purposes expressly stated in the Agreement shall not be

provided.
