(v) Applicable Maximum Rates, Charges and Surcharges. In accordance with Section 6.3 of Natural's Rate Schedule FTS, the Negotiated Monthly Inclusive

Reservation Rates are inclusive of all Account 858 surcharges set forth in Natural's FERC Gas Tariff which are or may be applicable to service

provided to Shipper under the FTS Agreement. The Negotiated Monthly Inclusive Reservation Rates shall be applicable at all times during the

Negotiated Rate Term. Unless otherwise expressly provided herein, all applicable maximum rates, charges, surcharges and penalties of any nature set

forth in Natural's FERC Gas Tariff shall apply to service provided to Shipper under the FTS Agreement, including without limitation all applicable

gathering charges, offshore charges, lateral line charges and ACA surcharges.

 

4/ Eligible Receipt Points: The Negotiated Rates shall only apply to transportation service provided from the following receipt points and only up to the

point MDQ indicated below for each point:

 

Primary Receipt Points: Red River No. 2, PIN NO. 25070 (2,325 Dth of MDQ 12/1/2002 - 3/31/2003); Chico Plt., PIN NO. 901501 (17,675 Dth of MDQ 12/1/2002 -

3/31/2003) and (20,000 Dth of MDQ 4/1/2003 - 11/30/2006).

 

Secondary Receipt Points: The Negotiated Rates shall apply to service provided from all secondary receipt points permitted under the FTS Agreement.

 

5/ Eligible Delivery Points: The Negotiated Rates shall only apply to transportation service provided to the following delivery points:

 

Primary Delivery Points: Illinois Power/Centralia, PIN No. 900170 (20,000 Dth of MDQ).

 

Secondary Delivery Points: The Negotiated Rates shall apply to NICOR (PIN No. 9258), NIPSCO (PIN No. 909260), PGL&C (PIN No. 909285), MidAmerican (PIN No.

10568), Illinois Power (PIN No. 909999), ANR-Joliet #2 (PIN No. 904758) and all storage and pooling points within the zones traversed by the primary path

as permitted by the FTS Agreement.

 

Incremental Rate Secondary Delivery Points: Incremental Rate Secondary Delivery Points shall include Midwestern Kankakee (PIN Number 25400) with an

additional incremental daily volumetric reservation rate of $.06 per Dth applied to all quantities transported on any day to Midwestern Kankakee (PIN No.

25400) for the period commencing February 21, 2003 and ending November 30, 2006.

 

6/ Eligible Primary Pathing. Shipper's primary path under the FTS Agreement will be from Natural's Midcontinent Zone northeast through Segment 14 and south

to Natural's interconnect with Illinois Power in Segment 28.

 

7/ Aggregate Receipt/Delivery Quantity Limitation. The Negotiated Rates shall apply to all quantities received or delivered by Natural for Shipper's account

in any particular transportation zone which are transported on a primary or secondary firm basis, to the extent that such aggregate firm receipt or

delivery quantities do not exceed the aggregate amount of Shipper's Eligible Point MDQs set forth above for receipts or deliveries, as applicable, in such

zone. Unless Natural otherwise expressly agrees in writing, service provided in excess of the applicable zone quantity limitation shall be charged all

applicable maximum rates, charges and surcharges set forth in Natural's FERC Gas Tariff.
