10/Applicable Maximum Rates, Charges and Surcharges. The applicable maximum ACA surcharge, or any successor to such surcharge and all applicable maximum

penalties and charges of any nature set forth in Natural's FERC Gas Tariff which are not base rates or surcharges, shall apply to service provided to Shipper

under the FTS Agreement.

 

11/Eligible Receipt Points. The negotiated rates shall only apply to transportation service provided from the following receipt points:

 

Primary Receipt Points: Horizon/NGPL McHenry, PIN No. 39755 (100,000 Dth/d MDQ).

 

Secondary Receipt Points: The negotiated rates shall not apply to service provided from any secondary receipt points. Service from any secondary receipt

points shall be charged the applicable maximum rate set forth in Natural's FERC Gas Tariff, as may be revised from time to time.

 

12/Eligible Delivery Points: The negotiated rates shall only apply to transportation service provided to the following delivery points:

 

Primary Delivery Points: Nicor Gas/NGPL Rockford, PIN No. 900012 (85,000 Dth/d MDQ); Nicor Gas/NGPL Sycamore, PIN No. 900013 (10,000 Dth/d MDQ); and Nicor

Gas/NGPL South Dixon, PIN No. 900019 (5,000 Dth/d MDQ).

 

Secondary Delivery Points. The negotiated rates shall only apply to transportation service provided to secondary delivery points within the zones traversed by

the primary path which are physical points of interconnect within the Nicor Gas CDP (PIN No. 9258) located on the Illinois lateral downstream of NGPL

compressor station 110 and upstream of NGPL compressor station 116. Service to all other secondary delivery points shall be charged the applicable maximum

rate set forth in Natural's FERC Gas Tariff, as may be revised from time to time.

 

13/ Aggregate Receipt/Delivery Quantity Limitations. The negotiated rates shall apply to all quantities received or delivered by Natural for Shipper's account in

any particular transportation zone from the Eligible Receipt Points to the Eligible Delivery Points, regardless of whether such quantities are transported on

a primary or secondary firm basis, to the extent that such aggregate firm receipt or delivery quantities do not exceed the aggregate amount of Shipper's

Eligible Point MDQs set forth in footnotes 11 and 12 above for receipts or deliveries, as applicable, in such zone.

 

14/ Applicable Rate Considerations. Unless Natural otherwise expressly agrees in writing. Shipper shall not be entitled to change any of its Primary Receipt

Points or Primary Delivery Points under the FTS Agreement if such change would result in Shipper paying a transportation rate to Natural which is lower than

the applicable negotiated rates.
