1/ The Negotiated Rate Exhibit with Shipper does not deviate in any material respect from the applicable Form of Service Agreement in Natural's FERC Gas Tariff.
2/ Negotiated Rate Term. The negotiated rates set forth herein shall be in force during a term commencing on April 1, 2008 through March 31, 2011.
3/ Eligible Firm Quantities.
(a) The Negotiated Rates set forth herein shall apply to storage service provided by Natural to Shipper under Rate Schedule NSS with an Eligible Contract
Maximum Storage Volume ("MSV") of Six Hundred Eighty Nine Thousand Four Hundred Seventy Five (689,475) Dth and an Eligible Contract MDQ of Nine
Thousand One Hundred Ninety Three (9,193) Dth per day, MDQ of 9,193 Dth per day and an MSV of 689,475 Dth on the Amarillo Leg, and an MDQ of 0 Dth per
day and a MSV of 0 Dth on the Gulf Coast Leg, with an Amarillo Percentage equal to one hundred percent (100%) and a Gulf Coast Percentage equal to
zero (0%).
(b) The Negotiated Rates set forth herein shall apply to storage service provided by Natural to Shipper under Rate Schedule NSS with an Eligible Contract
Maximum Storage Volume ("MSV") of Eight Hundred Ten Thousand Five Hundred Twenty Five (810,525) Dth and an Eligible Contract MDQ of Ten Thousand Eight
Hundred Seven (10,807) Dth per day. MDQ of 10,807 Dth per day and an MSV of 810,525 Dth on the Amarillo Leg, and an MDQ of 0 Dth per day and a MSV of
Dth on the Gulf Coast Leg, with an Amarillo Percentage equal to one hundred percent (100%) and a Gulf Coast Percentage equal to zero (0%).
4/ Fixed Negotiated Monthly Base Reservation Rate. The Negotiated Monthly Base Reservation Rate per Dth of MDQ (Peak and Off-Peak periods) shall apply only to
service provided by Natural to Shipper under the Rate Schedule NSS Agreement, subject to all other terms and conditions set forth herein.
